1851 Sale of Ground in Bradmore Street Cambridge - old document

This original appointment deed Dated 24th December 1851 was for the sale of land by Mr George Johnson, who was a Cambridge surgeon, to Mr Samuel Moore, a publican (possibly the same man that ran the Fort St George Pub by the river at Chesterton). The land was a piece of freehold ground in Bradmore Street, off East Road Cambridge.

Dated 24th December 1851

Mr George Johnson

to

Mr Samuel Moore

Appointment of a piece of freehold Ground situate at Bradmore Street in the parish of Saint Andrew the Less, Cambridge

This Indenture made the twenty fourth day of December in the year of our Lord One thousand eight hundred and fifty one between George Johnson of the Borough of Cambridge Surgeon of the first part Samuel Moore of the same place publican of the second part and John Eaden the younger of the same place solicitor of the third part. Whereas by an indenture dated the twenty first day of October One thousand eight hundred and fifty and made between the Reverend Robert Willis of the one part and the said George Johnson of the other part amongst other here dments the piece or parcel of ground hereinafter particularly described and intended to be hereby appointed and released was conveyed and assured to such uses and in such manner as the said George Johnson should at any time or from time to time by any deed or deeds courting or courtings appoint and in defauel of such appointment to the use of the said George Johnson his heirs and assigns for ever and the said George Johnson thereby declared that his widow should not be entitled to dower and or in respect of the said hereditaments And Whereas the said George Johnson caused the said hereditaments to be part up for sale by public auction at the Waggon and Horses public house Cambridge aforesaid on the Sixteenth day of October now last and at such sale the said Samuel Moore being the highest bidder for Lot 21 (being the piece of ground hereinafter described) was declared the purchase thereof at the price of seventeen pounds three shillings. From this Indenture Witnessed that in pursuance of the said Contract and in consideration of the sum of seventeen pounds and three shillings of sterling money paid by the said Samuel Moore to the said George Johnson the receipt where of the said George Johnson hereby acknowledges and therefrom hereby rebases and for ever discharges the said Samuel Moore his heirs and assigns He the said George Johnson by virtue and in exercise of the power ensued to him by the said recited indenture and all other powers enabling him in that behalf Doth by this deed absolutely dercel himil and appoint that All That piece of ground situate in Bradmore Street in the parish of Saint Andrew the Less in the Borough of Cambridge being Lot 21 in the plan and particulars at the said sale and containing in part next the said street and in width for the whole depth sixteen feet four inches and in depth eighty one feet or thereabouts abutting north on Bradmore Street aforesaid west on Ground Of           

East on other ground of the said George Johnson and south on a six feet back way which separates it from Caius College Land together with full and free right of way in over and upon Bradmore Street aforesaid and in over and upon the said backway of six foot to another way leading northward into Bradmore Street aforesaid in and over and upon the said last mentioned way into Bradmore Street to the said Samuel Moore paying a proportionate part with the other owners and occupiers of ground adjoining thereto of making and maintain the said respective ways and all and singular the rights members and appurtenances to the said piece of ground belonging or appertaining and the reversion and reversions, remainder and remainders yearly and other rents issues and profits there of and all the estate right title in trust property claim and demand whatsoever of the said George Johnson in or to the same premises or any part there of shall immediately after the execution of these presents remain and be To the uses following that is to say To such uses and in such manner as the said Samuel Moore shall at any time or from any time to time by any deed or deeds counting or countings direct or appoint and in default or such direction or appointment To the use of the said Samuel Moore and his assigns during the term of his natural life without impeachment of waste and immediately after the deformation of that Estate by any means in his lifetime To the use of the said John Eaden his executors and administrators during the life of the said Samuel Moore on trust for the said Samuel Moore and his assigns and immediately after the determination of the estate hereby limited to the said John Eaden his executors and administrators To the use of the said Samuel Moore his heirs and assigns for ever And the said Samuel Moore hereby declares that his widow shall not be entitled to dower out or in respect of the said hereditaments thing made done or permitted by the said George Johnson to the contrary the above recited power at the time of the execution of these presents is a good valid and subsisting power and notwithstanding any such act deed matter or thing as aforesaid the said George Johnson now hath in himself lawful and absolute authority by these presents to limit or appoint the said hereditaments and premises with the appurtenances to the use aforesaid according to the here intent and meaning of these presents and also notwithstanding any such act deed matter or thing as aforesaid the said hereditaments and premises shall henceforth remain and be to the uses hereinbefore declared concerning the same and shall or may be peacefully or quietly held and enjoyed and the rents and profits thereof received and taken accordingly without any interruption or denial whatsoever by the said George Johnson or his heirs or any person or persons whomsoever claiming under or in trust for him and further that the said George Johnson and his heirs and every person whomsoever claiming any estate right title or interest at law or in equity in to or out of the said hereditaments and premises or any part thereof or from under or in trust for him or them will and shall at all times hereafter upon every reasonable request in writing and at the costs and charges of the said Samuel Moore his heirs or assigns make on execute every such lawful act deed appointment conveyance or assurance in the law whatsoever for more effectually appointing conveying or otherwise assuring the said hereditaments and premises to the uses aforesaid or to such uses and for such purposes as the said Samuel Moore his heirs or assigns shall shall order direct and in such manner as by him or these or his or theirs counsel in the law shall be reasonably advised and acquired And lastly that the said George Johnson his heirs executors administrators or assigns unless prevented by fire or other inevitable accident will at all times hereafter at the request cost and charges or the said Samuel Moore his appointees heirs or assigns produce and show forth unto the said Samuel Moore his appointees heirs or assigns or otherwise as occasion shall require the herein before recited indenture of the twenty first day of October One thousand eight hundred and fifty for the proof of manifestation and defence or the right title and interest of the said Samuel Moore his appointees heirs and assigns to the said hereby assured premises and the like request costs and charges shall and will be make and furnish to the said Samuel Moore his appointees heirs or assigns. Copies or extracts thereof and permit such copies or contracts to be examined with the originals In Witness where of the said parties to these presents have hereunto set their hands and seals the day and year first written above.

George Johnson Borough of Cambridge Surgeon

George Johnson was the house surgeon at (Old) Addenbrookes Hospital, Trumpington Street Cambridge from 1830-1844. He remained in Cambridge establishing himself as a general Practitioner in St Andrews Street. In 1847 he is reported in the newspaper as being a surgeon and attending to a poor child that burnt to death in the town, various other newspaper reports show that he was regularly called upon to examine in such cases. He eventually (by c.1855) bought and was living at Romsey Cottage, Mill Road Cambridge – after which Romsey Town is said to be named after – you can read more about Romsey Cottage by clicking HERE at the Mill Road History Society site.

Samuel Moore Publican

Although not 100% yet, the Samuel Moore ‘publican’ who purchased this land may have been the same Samuel Moore who had run the Fort St George Pub from about 1836 and is shown there in the newspapers in 1841 and was there until about 1856. He appeared many times in the newspapers in relation to the Fort St George, here is just one example:
